You’ve probably heard the news: as of January 2025, the Dutch Tax Administration (Belastingdienst) will tighten up its enforcement of the DBA Act to combat disguised employment. This means that if you work with freelancers, you and the freelancer will have to assess together whether the collaboration constitutes genuine self-employment. If it is deemed to be a disguised employment relationship, you as the client may be subject to penalties and retrospective tax liabilities.
In practice, it can be quite difficult to determine whether an assignment is employment or genuine freelance work. Several factors come into play, such as the degree of control and supervision exercised by the client and whether the freelancer is working at his or her own risk and expense. As a result of the DBA legislation, hiring a freelancer is not as straightforward as it once was.
